A Grand Jury is made up of not less than 5 or more than 9 persons. Essentially, a Grand Jury determines whether there is probable cause to believe that the person accused has committed the crime charged in the indictment and should stand trial. In most cases, the Grand Jury hears evidence after a probable cause hearing in District Court. If the Grand Jury determines that there is probable cause, then an indictment will be issued and your trial will be set in Circuit Court. An indictment is the formal document that charges the defendant with the crime. After the indictment is issued the defendant will be arraigned in circuit court. The same procedures for arraignment apply here as explained in General District Court.
